DURHAM COUNTY BASKETBALL ASSOCIATION
CONSTITUTION

1. |
NAME |
|
|
The Association shall be known as the Durham County Basketball Association, herein referred to as the Association. |
|
2. |
OBJECTS |
|
|
The Association shall administer and promote the game of basketball in the County of Durham (boundary as from 1st April 1996) According to the constitution of EB. |
|
3. |
MEMBERSHIP |
|
|
The Association is open to any club affiliated to the EB. The Association will actively encourage membership of women, young people, black and ethnic minority groups and people with disabilities. |
|
4. |
OFFICERS |
|
|
Honorary Officers of the Association shall be the President and Vice Presidents. Executive Officers of the Association shall be: Chairperson, Secretary, Treasurer, Minutes Sec., EB Registration Sec., Referee Sec., Major Events Promoter, Technical Sec., Women’s Representative, Press Officer, NATO Co-ordinator, Handbook Sec., Durham League Registration Sec., Disciplinary Chairperson, and the Schools’ Representative. Officers will be elected at the AGM. No person may become an Officer of the Association if that person holds an office within another Basketball Association. |

ORGANISATION |
|
|
An Executive Committee consisting of the Executive officers named above, plus one representative from any sanctioned league shall manage the affairs of the Association. A quorum of three officers is necessary for the transaction of business. The Executive Committee may set up sub-committees as required. Seven days notice of a meeting of the Executive Committee shall be given to all members. Items for consideration by the committee, other than those already listed on a proposed agenda, shall be forwarded in writing to the Secretary not later than three days before the date of the arranged meeting. Clubs with no elected members of the Executive Committee are allowed to send two representatives to a meeting at which any items they have raised is being discussed. Both representatives have the right to vote on this particular item only. |

6. |
FINANCE |
|
|
A Treasurer under the direction of the Executive Committee shall administer the finances of the Association. The Association funds shall be lodged at a bank and all cheques, drafts, etc., drawn on the Association account shall be signed by the Treasurer and countersigned by the Chairperson or the Secretary. The financial year of the Association shall end on the 30th April and a statement of accounts, up to that date, will be presented at the AGM. A current statement of finance shall be presented at other times at the request of the Executive Committee. Auditors shall be appointed annually to carry out an examination of the books. |

Each club affiliated to the Association shall pay an annual subscription, the amount to be decided at the AGM. The Association may raise additional funds in any way that the Executive Committee may think fit. |

7. |
ANNUAL GENERAL MEETING |
|
|
The AGM of the Association will be held before the end of July of each year when annual reports of the Executive Officers and audited accounts, made up to the 30th April, shall be presented. At least 21 days notice, specifying the place, date and time, together with the agenda shall be given to all club secretaries, who will advise their members. Each affiliated club shall be entitled to have two voting representatives at the AGM. A simple majority shall decide all resolutions and in the event of a tie the Chairperson of the meeting shall have the casting vote. Any club not represented by at least one member at the AGM will incur a fine of £20. |

8. |
SPECIAL GENERAL MEETING |
|
|
A Special General Meeting of the Association shall be convened on a resolution of the Executive Committee, or within one month of receipt by the Secretary, of a resolution signed by representatives of at least three clubs. Twenty-one days notice of place, date and time shall be given to all member clubs. A quorum of 75% is required for the meeting to be convened. |

9. |
AMENDMENTS TO THE CONSTITUTION |
|
|
Amendments to this constitution can only be made at the AGM or SGM. Written notice of any proposed amendment must be sent to the Secretary at least six weeks before the meeting. |

10. |
DISCIPLINE |
|
|
The Association shall have the power to take appropriate disciplinary action against leagues, clubs, officials and members within its jurisdiction. Any person or group of persons reported to the Association for any reason shall be given notice of and a copy of the report, before any disciplinary action is taken. |

11. |
APPEALS |
|
|
Members may appeal to the Association against any decision made by any sanctioned League or Committee. On appeal the person or group shall have the right to appear or give evidence to the Association Executive. A £10 deposit, which is returnable, shall accompany appeals to the Association if the appeal is upheld. Appeals against the Association shall be made to EB and include the appropriate fee. |

12. |
DISSOLUTION |
|
|
In the event of the Association being dissolved for any reason its assets shall be conveyed to EB. They will dispose of the assets as they deem fit. |
|
13. |
COMPETITIONS |
|
|
The Association shall sanction any league or competition provided that the majority of its members are members of the Association. Leagues or competitions will function under the jurisdiction of the Association. Sanction shall not be unreasonably withheld. All clubs and players taking part in the leagues or competitions sanctioned as above must be affiliated to EB. |

14. |
TROPHIES |
|
|
|
Any trophies won are the responsibility of the team and must be returned to the Secretary by the 1st March of the following season. Any club losing or damaging a trophy will have to reimburse the League for its value. |

|
15. |
DEVELOPMENT |
|
|
|
Promote and direct the development of Basketball in Schools/Colleges embodying Area Representative teams for talented young athletes. |
|
|
16. |
SPECIAL CONSIDERATIONS |
|
|
|
Any point not covered by this constitution shall be left to the discretion of the Executive Committee and reported to the AGM. |
